1.1 About these Terms#

These Terms and Conditions ("Terms") govern your access to and use of the website vibhapsychology.com, the VIBHA School of Psychology learning platform, and all courses, cohorts, workshops, and related services (collectively, the "Services") offered by VIBHA School of Psychology, a sole proprietorship registered in India with its principal place of business at Available on request ("VIBHA School of Psychology", "we", "us", "our").

By accessing our website, registering for a course, or making payment, you enter into a binding agreement with us on these Terms. If you do not agree, do not use the Services.

These Terms are published in accordance with the Information Technology Act, 2000, the rules made thereunder, and the Consumer Protection (E-Commerce) Rules, 2020. This is an electronic record generated by a computer system and does not require any physical or digital signature.

1.2 Eligibility#

You may enrol only if you:

• are at least 18 years of age, or are between 16 and 18 and enrol with the consent of a parent or legal guardian who accepts these Terms on your behalf;
• are legally capable of entering into a binding contract under the Indian Contract Act, 1872;
• provide accurate, current and complete information during registration; and
• meet any academic or professional prerequisites stated on the course page.

We may verify eligibility at any time and may cancel an enrolment obtained through inaccurate or incomplete information.

1.3 Nature of our Services — please read carefully#

VIBHA School of Psychology provides supplementary professional education and skills training. Our courses are designed to complement, not replace, formal academic degrees and statutory licensure.

You expressly acknowledge and agree that:

• We are not a university and are not a degree-granting institution. We do not award degrees, diplomas, or any qualification recognised by the University Grants Commission (UGC), the All India Council for Technical Education (AICTE), or any other statutory academic authority.
• Our certificates are certificates of course completion issued by a private training provider. They are not a licence, registration, or authorisation to practise clinical psychology, counselling psychology, psychotherapy, or any regulated healthcare profession in India or elsewhere.
• Practice as a Clinical Psychologist in India is regulated by the Rehabilitation Council of India (RCI) and requires qualifications and registration prescribed under the Rehabilitation Council of India Act, 1992. Completing our course does not confer RCI registration and does not qualify you to practise as a Clinical Psychologist.
• We make no representation or guarantee regarding employment, internship placement, admission to any further programme, income, or professional outcomes of any kind.
• Nothing in our courses, materials, sessions, or communications constitutes medical advice, psychological diagnosis, psychotherapy, or treatment for you or any third party.

If you require mental healthcare for yourself, please consult a qualified, registered mental health professional. Our teaching faculty do not enter into a therapist–client relationship with learners by virtue of teaching them.

1.4 Enrolment and seat confirmation#

A seat is confirmed only when full payment, or the agreed first instalment, is received in our designated bank account and we issue a written confirmation by email. Registration forms, expressions of interest, and pending payments do not reserve a seat.

Seats are limited and allotted on a first-confirmed basis. We may close enrolment at any time without notice.

1.5 Course delivery and changes#

The cohort runs over a period of sixteen weeks. Sessions are delivered live over Zoom on weekends, and in person at our Ahmedabad centre for learners enrolled under a specific institutional collaboration. Recordings of live sessions are made available on the learning platform. Supporting material is made available through our learning platform and community channels.

We reserve the right, acting reasonably, to:

• adjust the schedule, sequence, or timing of sessions;
• substitute faculty or guest faculty of comparable standing;
• update, revise, or improve curriculum content; and
• change the delivery mode of a session where circumstances require it.

Where a change is material, we will notify you by email or through the official cohort communication channel. Changes of this kind do not entitle you to a refund, except as set out in the Refund and Cancellation Policy.

1.6 Your account and access#

Your login credentials are personal to you. You must not share, sell, transfer, or permit any other person to use your account, session links, or course materials. Enrolment is for one named individual only.

We monitor for credential sharing and concurrent access. Where we detect sharing, we may suspend or terminate access without refund and pursue any other remedies available to us.

You are responsible for the security of your credentials and for all activity under your account. Notify us immediately at drsarthakpsychology@gmail.com if you suspect unauthorised use.

1.7 Intellectual property#

All course content — including recordings, slides, handouts, case materials, assessments, question banks, frameworks, the learning platform, and the VIBHA name and marks — is the exclusive property of VIBHA School of Psychology or its licensors, and is protected under the Copyright Act, 1957 and the Trade Marks Act, 1999.

You are granted a limited, personal, non-exclusive, non-transferable, revocable licence to access the content for your own learning during your enrolment.

You must not:

• record, screen-capture, photograph, download, or reproduce any live session or material, except where we expressly permit it in writing;
• upload, share, circulate, or resell any material, including to classmates, coaching groups, cloud drives, messaging groups, or public platforms;
• use any material to create competing courses, content, or training material; or
• remove, obscure, or alter any proprietary notice.

Unauthorised recording or distribution is a criminal offence under the Copyright Act, 1957 and will result in immediate termination without refund, in addition to civil and criminal action and a claim for damages.

1.8 Learner conduct#

You agree to conduct yourself professionally in all sessions and community spaces. Detailed expectations are set out in the Code of Conduct, which forms part of these Terms.

1.9 Third-party platforms#

Our Services are delivered using third-party platforms including Zoom, Discord, WhatsApp, and our payment gateway. Your use of those platforms is governed by their own terms and privacy policies. We are not responsible for their availability, security practices, or acts and omissions.

1.10 Limitation of liability#

To the maximum extent permitted by applicable law:

• Our Services are provided on an "as is" and "as available" basis. We do not warrant uninterrupted or error-free delivery, and we are not liable for disruptions caused by internet connectivity, power failure, platform outages, or your own equipment.
• We are not liable for any indirect, incidental, special, consequential, or punitive loss, or for loss of profits, opportunity, data, or reputation.
• Our total aggregate liability arising out of or in connection with these Terms and the Services, whether in contract, tort, or otherwise, shall not exceed the total course fee actually paid by you to us.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, wilful misconduct, or death or personal injury caused by negligence.

1.11 Indemnity#

You agree to indemnify and hold harmless VIBHA School of Psychology, its founders, faculty, employees, and partners against any claim, loss, damage, liability, cost, or expense (including reasonable legal fees) arising from your breach of these Terms, your infringement of any third-party right, your unauthorised use or distribution of our content, or your breach of learner confidentiality obligations.

1.12 Suspension and termination#

We may suspend or terminate your access immediately, without refund, if you materially breach these Terms or the Code of Conduct, share credentials or content, engage in harassment or discriminatory conduct, breach confidentiality, or act in a way that endangers or seriously disrupts other learners, faculty, or any person.

Where circumstances permit, we will give you notice and an opportunity to explain before acting.

1.13 Force majeure#

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disaster, epidemic or pandemic, government order, civil unrest, strike, war, fire, flood, failure of telecommunications or internet infrastructure, or failure of a third-party platform. Where such an event occurs, we will make reasonable efforts to reschedule affected sessions.

1.14 Governing law and jurisdiction#

These Terms are governed by the laws of India. Subject to the Grievance Redressal Policy below, the courts at Ahmedabad, Gujarat shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.

Before commencing proceedings, the parties shall first attempt resolution through our grievance redressal process in good faith.

Nothing in this clause limits your rights as a consumer to approach the appropriate consumer forum under the Consumer Protection Act, 2019.

1.15 Changes to these Terms#

We may amend these Terms from time to time. The version in force on the date you make payment governs your enrolment for that cohort. We will post the updated version with a revised "Last updated" date and, where changes are material, notify enrolled learners by email.

1.16 Severability and entire agreement#

If any provision of these Terms is held invalid or unenforceable, that provision shall be modified to the minimum extent necessary, and the remaining provisions shall remain in full force.

These Terms, together with the policies referenced in them, constitute the entire agreement between you and us regarding the Services and supersede all prior discussions, representations, brochures, and marketing material.
